Consent Searches

Question

What constitutes valid consent to search, and how easily can that consent be withdrawn?

Accepted Answer

Valid consent to search requires that the consent be given voluntarily, intelligently, and without coercion or duress. Under the Fourth Amendment, as established in Schneckloth v. Bustamonte (1973), the totality of the circumstances is examined to determine whether consent was freely and voluntarily given. Key factors include: (1) the person must have the authority to consent to the search of the area or property in question; (2) consent must not be obtained through threats, intimidation, or false claims of authority (e.g., claiming to have a warrant when none exists); (3) the individual must be aware of their right to refuse, although officers are not required to inform them of this right; and (4) consent must be clear and unequivocal, whether expressed verbally or through conduct.

Regarding withdrawal, consent to search can be withdrawn at any time during the search. The individual simply needs to clearly and unambiguously communicate their desire to revoke consent, either verbally (e.g., stating "I no longer consent to this search") or through physical actions (e.g., closing a door). Once consent is withdrawn, officers must immediately stop the search unless they have independent legal authority to continue, such as probable cause or a warrant. Any evidence discovered after consent is revoked may be subject to suppression. However, evidence lawfully discovered before the withdrawal of consent remains admissible. The ease of withdrawal underscores that consent searches are fundamentally based on the voluntary cooperation of the individual, and that cooperation can be rescinded at any point.
