Threat Perception Without a Weapon

Question

How should officers articulate perceived threat when no weapon is ultimately found?

Accepted Answer

Courts evaluate an officer’s threat assessment under the objective reasonableness standard from Graham v. Connor, 490 U.S. 386 (1989). This means:

Officers are judged based on what they reasonably perceived at the moment force or control was used, not on what is discovered later.

Therefore, when no weapon is ultimately found, the articulation must focus on specific, observable facts that led a reasonable officer to believe the suspect posed an imminent threat.

Below is the articulation structure courts consistently accept.

1. Explain the Totality of the Circumstances
Officers must describe everything they knew before and during the encounter, including:

Nature of the call (e.g., “armed disturbance,” “violent domestic,” “man with a gun”)

Prior knowledge of the suspect (violent history, threats, warrants)

Environmental factors (darkness, confined space, crowds, lack of cover)

Officer‑safety considerations (outnumbered, backup far away, suspect’s size/strength)

Supporting case law
Graham v. Connor (1989) — reasonableness judged from the perspective of a reasonable officer on scene.

Terry v. Ohio, 392 U.S. 1 (1968) — officers may act on reasonable suspicion that a person is armed and dangerous.

2. Identify the Specific Behaviors That Created the Perceived Threat
Courts require articulable facts, not vague conclusions.

Examples of threat‑indicating behaviors:

Reaching into waistband, pockets, or under clothing

Blading the body or shielding one side

Ignoring or refusing commands

Sudden movements toward concealed areas

Clenching fists, tensing muscles, adopting a fighting stance

Attempting to flee or rapidly close distance

Verbal threats or aggressive statements

Supporting case law
Illinois v. Wardlow, 528 U.S. 119 (2000) — unprovoked flight contributes to reasonable suspicion.

United States v. Arvizu, 534 U.S. 266 (2002) — officers may consider the totality of circumstances, including seemingly innocent factors.

3. Explain Why Those Behaviors Suggested a Weapon
Even if no weapon is found, officers must articulate why the behavior matched known pre‑attack indicators.

Examples:

“Suspects commonly draw weapons from the waistband area.”

“The subject kept his right hand concealed despite repeated commands.”

“The subject’s movements were consistent with retrieving or hiding a weapon.”

Supporting case law
Terry v. Ohio (1968) — officers may act on reasonable suspicion that a suspect is armed based on observed behavior.

United States v. Brown, 188 F.3d 860 (7th Cir. 1999) — furtive movements toward concealed areas can justify belief the suspect is armed.

4. Emphasize the ‘Unknown Hands’ Principle
Courts recognize that hands pose the greatest threat, and concealed hands are a legitimate safety concern.

Supporting case law
United States v. Sanders, 994 F.2d 200 (5th Cir. 1993) — refusal to show hands supports reasonable suspicion.

United States v. Hensley, 469 U.S. 221 (1985) — officers may take reasonable steps to protect themselves.

5. Explain Why Immediate Action Was Necessary
Courts want to know why waiting was unsafe.

Examples:

The suspect was rapidly closing distance

Civilians were nearby

The suspect’s escalating behavior suggested imminent attack

The suspect’s refusal to comply increased the threat level

Supporting case law
Plumhoff v. Rickard, 572 U.S. 765 (2014) — officers may act decisively when facing imminent threat.

Scott v. Harris, 550 U.S. 372 (2007) — officers need not wait for harm to occur before acting.

6. Clearly State That the Threat Was Based on Reasonable Perception, Not Outcome
Courts repeatedly affirm:

Officers do not have to be right — they must be reasonable.

Supporting case law
Graham v. Connor (1989) — judged at the moment force is used, not with hindsight.

Saucier v. Katz, 533 U.S. 194 (2001) — officers may make reasonable mistakes about the facts.

7. Avoid Vague or Conclusory Language
Courts reject statements like:

“He looked dangerous.”

“I feared for my life.”

“He was acting suspicious.”

Officers must provide specific, observable facts instead.
