Warrantless Entry and Exigency

Question

When can officers enter a home without a warrant, and what qualifies as exigent circumstances?

Accepted Answer

When Officers May Enter a Home Without a Warrant, and What Qualifies as Exigent Circumstances
The Fourth Amendment generally prohibits warrantless entry into a home. The Supreme Court calls the home’s threshold a “firm line” that officers may not cross without a warrant unless a narrow, well‑defined exception applies.
(Payton v. New York, 445 U.S. 573 (1980))

There are four lawful bases for entering a home without a warrant:

Voluntary consent

Exigent circumstances

Arrest warrant for the resident

Probation/parole search conditions

The most complex of these is exigent circumstances, which includes what courts refer to as “Hot Pursuit.”

1. Consent
Entry is lawful when a person with actual or apparent authority freely and voluntarily consents.

Supporting case law
Schneckloth v. Bustamonte (1973) – Consent must be voluntary.

Georgia v. Randolph (2006) – A present co‑occupant’s refusal overrides consent.

Fernandez v. California (2014) – If the refusing occupant is lawfully removed, remaining consent is valid.

2. Exigent Circumstances
Exigent circumstances justify entry only when officers have:

Probable cause,

A true emergency requiring immediate action, and

No time to obtain a warrant.

Courts recognize three primary exigency categories:

A. Emergency Aid
Officers may enter when they reasonably believe someone inside is injured or in immediate danger.

Case law
Brigham City v. Stuart (2006) – Entry allowed to stop ongoing violence.

Michigan v. Fisher (2009) – Chaotic scene + blood justified entry.

Caniglia v. Strom (2021) – “Community caretaking” alone is NOT enough; must be a real emergency.

B. “Hot Pursuit” of a Fleeing Suspect
Important caveat:
The Supreme Court has made clear that “Hot Pursuit” is not a magic phrase and does not automatically justify home entry, especially for minor offenses.

Case law
Warden v. Hayden (1967) – Continuous pursuit of an armed robbery suspect justified entry.

United States v. Santana (1976) – Suspect retreated into home; officers could follow.

Lange v. California (2021) – Critical holding:

There is no categorical rule allowing warrantless home entry in “hot pursuit” of a fleeing misdemeanant.
Courts must evaluate the totality of the circumstances to determine if a true exigency exists.

What courts require
To justify entry under “Hot Pursuit,” officers must articulate:

Continuous, immediate pursuit (not delayed)

Probable cause for a jailable offense

A real urgency such as:

risk of escape

danger to officers or others

imminent destruction of evidence

If none of these are present, pursuit alone does NOT justify entry.

C. Imminent Destruction of Evidence
Entry is allowed when officers reasonably believe evidence will be destroyed before a warrant can be obtained.

Case law
Kentucky v. King (2011) – Entry allowed if police did not create the exigency by violating the Fourth Amendment.

Schmerber v. California (1966) – Evidence destruction (blood alcohol) justified warrantless action.

Requirements
Probable cause that evidence is inside

Objective facts showing imminent destruction

Officers did not create the exigency through unlawful conduct

3. Arrest Warrant for the Resident
An arrest warrant allows officers to enter a suspect’s own home if they have reason to believe the suspect is inside.

Case law
Payton v. New York (1980) – Arrest warrant authorizes entry into suspect’s residence.

Steagald v. United States (1981) – Officers need a search warrant to enter a third party’s home.

4. Probation/Parole Search Conditions
If a resident is subject to a valid search condition, officers may enter to conduct a compliance search.

Case law
United States v. Knights (2001) – Probation search condition valid with reasonable suspicion.

Samson v. California (2006) – Parolees may be searched without suspicion under valid conditions.

What Does Not Qualify as Exigent Circumstances
Courts consistently reject:

❌ Officer convenience
❌ Generalized “community caretaking” (Caniglia)
❌ Minor offenses without urgency (Lange)
❌ Speculation without objective facts
❌ Exigency created by unlawful police conduct
❌ “Freezing the scene” without a true emergency
