Weapon Retention Escalation

Question

When is a weapon retention issue enough to elevate force options?

Accepted Answer

Under the Fourth Amendment, the legality of force is governed by objective reasonableness (Graham v. Connor, 490 U.S. 386 (1989)).
A weapon‑retention threat—even if the suspect never gains control of the weapon—can justify elevating force options when the suspect’s actions create an imminent risk that the officer’s firearm or other weapon could be taken and used against the officer or others.

Courts consistently hold that:

A suspect attempting to grab, control, or interfere with an officer’s weapon constitutes a deadly‑force threat, even if the suspect never actually obtains the weapon.

This aligns directly with the Dynamic Resistance Model (DRM), which classifies subject behavior and corresponding officer responses.

1. DRM Classification: Weapon‑Retention Threat = Assaultive (Bodily Harm) or Assaultive (Serious Bodily Harm/Death)
In the DRM:

Passive / Defensive Resistance → lower‑level control

Active Resistance → physical control techniques

Assaultive (Bodily Harm) → intermediate force

Assaultive (Serious Bodily Harm/Death) → deadly force

A weapon‑retention threat immediately elevates the subject’s behavior to:

Assaultive – Serious Bodily Harm/Death
Why?
Because if a suspect gains control of an officer’s firearm, baton, TASER, or knife, the risk of death or serious injury is immediate and extreme.

Thus, under DRM, force options may escalate rapidly, including up to deadly force, depending on the immediacy and severity of the threat.

2. Case Law Supporting Elevation of Force During Weapon‑Retention Threats
Courts have repeatedly upheld elevated force—including deadly force—when a suspect attempts to grab or interfere with an officer’s weapon.

A. Suspect attempts to grab officer’s firearm
Plakas v. Drinski, 19 F.3d 1143 (7th Cir. 1994)
Court held that an officer may use deadly force when a suspect attempts to obtain a weapon that could be used against the officer.

Thompson v. Hubbard, 257 F.3d 896 (8th Cir. 2001)
Deadly force justified when suspect reached for officer’s gun; actual possession not required.

B. Suspect attempts to disarm officer during struggle
Estate of Larsen v. Murr, 511 F.3d 1255 (10th Cir. 2008)
Officers may escalate force when a suspect’s actions create a reasonable belief that the suspect is attempting to gain control of a weapon.

C. Deadly‑force standard applies even if the suspect never obtains the weapon
Saucier v. Katz, 533 U.S. 194 (2001)
Officers may make reasonable mistakes about the level of threat; the question is whether a reasonable officer could believe the suspect posed a deadly threat.

Scott v. Harris, 550 U.S. 372 (2007)
Officers need not wait for a suspect to actually cause harm before responding to a deadly threat.

3. What Officers Must Articulate
Courts require specific, observable facts, not conclusions.

Officers should articulate:

A. The suspect’s actions
Grabbing or reaching toward the officer’s firearm

Pulling on the officer’s holster

Attempting to remove retention devices

Reaching for a TASER, baton, or knife

Wrestling or grappling near the weapon side

Pinning the officer’s weapon arm

B. Why those actions created a deadly‑force threat
“If the suspect gained control of my firearm, deadly force against me or others was imminent.”

“The suspect’s hand made contact with my holster.”

“The suspect was actively pulling at my weapon belt.”

“The suspect attempted to disable my retention system.”

C. Environmental and tactical factors
Officer outnumbered

Confined space

Ground fight

Weapon exposed or unsecured

Backup far away

D. Why immediate escalation was necessary
“Waiting would have allowed the suspect to gain control of my weapon.”

“The suspect’s actions created an imminent risk of serious bodily harm or death.”

4. Why Weapon‑Retention Threats Are Treated as Deadly‑Force Threats
Courts recognize that:

A suspect gaining control of an officer’s weapon is one of the most dangerous situations in policing.

Even a brief attempt to grab a weapon can justify elevated force because:

The officer cannot safely disengage

The suspect’s intent is unknown but potentially lethal

The risk to the officer and public is immediate

The officer has only seconds to react

This is why DRM places weapon‑retention threats at the highest threat level.

5. Legal Caveat
This explanation provides general legal principles, but officers should always seek licensed legal advice for any situation involving use of force, threat articulation, or potential liability.

Reliable sources of legal guidance include:

Your law enforcement union or association

Your agency’s legal department or general counsel

Qualified private legal counsel

These professionals can provide advice tailored to your jurisdiction, agency policy, and the specific facts of your incident.
